“I,
John Fox, of Jefferson township, Richland County, Ohio, do make and
publish this my last will and testament: I give, demise and bequeath to my brother Daniel Fox, of
Jefferson township, Richland County, Ohio, all my property, real, personal, and
mixed, and all rights and credits due me at my decease, to have and to hold all
of said property to the only proper use of him, the said Daniel Fox, his heirs
and assigns, forever. But the above
gift and demise is upon the condition that the said Daniel Fox within one year
after the date of my death pay to my nephew, Chauncey H. Traxler, one
thousand dollars ($1,000), and also within two years from the date of my death
pay to my sister, Elizabeth Fox, one thousand dollars ($1,000). In witness whereof I have hereunto set my hand and
seal, the 3d. day of March, 1883. ---
JOHN FOX.”
“Signed and acknowledged by the said John Fox as his last will and testament in our presence and by us at his request signed as witnesses in his presence and in the presence of each other. – Wm. F. Madden and A.H. Redding.”
The
provisions of the above will exclude from any share in his estate the following
married sisters of Fox: Lavinia Donaugh
(Bellville), Susannah Traxler (Independence), Mary Burger (Buena
Vista, Tuscarawas county). Elizabeth,
the sister mentioned in the will, is an imbecile and hence the provision made
for her.
